Yesterday I revealed how Jim “Pinky” Starr has managed to obtain legal medicinal cannabis in Britain.  See here. I’ve been asked to clarify whether the method set out in my article applies throughout Europe.

I’m not a lawyer.  I believe that this information is correct but don’t blame me if James Brokenshire decides he’s going to ride roughshod over justice and European law!

All I know is that (with due respect to my friends with genuine illness), if I could develop the right aches and pains, I’d be straight over to Holland!

As I understand it, Ireland is now the only EU country where this wouldn’t work. However, that won’t last long. The reason that the procedure set out works is because of this:

So, the only remaining problem is actually enabling UK doctors to prescribe medicinal herbal cannabis and developing a local supply chain. It seems to me that as we’re all part of the EU this is going to be impossible to stop.

I think that the breakthrough I’ve been campaigning for since the late 1970s has finally happened!

    I really think there is a very sound argument here. Of course these disgusting people in the corridors of power in Westminster will not like this one bit and will try to stop it.

    The letter from the Home Office is quite something. In the past the police have tried to prosecute people for Magic Mushrooms or dried San Pedro cuttings for possession of class a drugs, in both cases they were thrown out of court, on the grounds that plants containing class a drugs were not illegal (in the case of mushrooms they changed the law to make it so). A key part of the defense argument of both cases were letters circulated by the Home Office at the time stating they did not consider fresh magic mushrooms or dried tissue of mescaline containing cacti illegal.

  2. I’m sure you’re right on all of this, Peter. I suppose the Lib Dems might be more persuaded than the Tories. They’re usually high on something or other.

    Sorry, don’t mean to be facetious. But the LDs, many of them anyway, have always been more interested in your sort of campaign. I remember a green paper once by one of them on legalising hemp. The issue is one of perception, of course, and of the signal it gives. Once holding the responsibility of office the possible is more impossible, politically than first appeared, due to the press and point-scoring by other parties.

  3. I think your assessment of the situation is correct on this, Peter. I studied the Schengen document a few days ago with the relative Clause on this:

    Article 75
    1. As regards the movement of travellers to the territories of the Contracting Parties or their movement within these territories, persons may carry the narcotic drugs and psychotropic substances that are necessary for their medical treatment provided that, at any check, they produce a certificate issued or authenticated by a competent authority of their State of residence.

    It’s great that Pinky discovered the mechanism to do this and that some positive action is taking place. This is good news!

  4. Good morning Peter.

    This is great news for all. I have been quiet optimistic over the past weeks about the coalition changing the laws on our lovely herb. Lets hope more and more people do just as Pinky has done and show the home office that we are ahead of them and not to be messed with. I must admit though that I am a little bewildered as to what people like James Brokenshire will be thinking about all this. Also about your freedom, we all know about that website and how much of a solid argument we all put forward. Wwhen will we hear about that and how will they address the issue?

    One of the most worrying aspects of all this is the language guys like Jimmy use, such as getting people free of addiction. well most responsible cannabis users are not addicts and actually enjoy using the herb. They do not wish to be free of it.

    Lets hope proposition 19 is passed (it looks good at this moment) so that then we can start the snowball rolling, because cannabis aint going nowhere soon.

  5. They never let anything like this persist Peter and will sadly find a way round it. The law is never positively stated for the courts, only us mugs.

    I would vote for a platform looking to sensibly decriminalise drug use (let’s not just move from vice to rackets), assisting suicide and other matters – maybe promising to hand over the economy to the BoE for 5 years so we don’t get distracted into voting on that red herring.

  9. Hi adhd,

    I am aspergers, I saw my Doctor in the UK this morning and he has put on record that he is happy for me to go to holland and seek a prescription for legal herbal cannabis if the appropriate dutch doctor sees fit to prescribe it to me.

    I imagine there is a similarly strong case for adhd. I certainly know of one or two adhd people who knowingly self-medicate, preferring it to the prescription drugs that are available.

    I certainly prefer it when my adhd friends have smoked enough marijuana.

    • I also have A.D.D. (without hyperactivity) Cannabis helps my condition like nothing else….Now getting a G.P on board is another thing altogether, as they know nothing about A.D.H.D/ A.D.D. in adults
